These Terms of Use ("Terms") govern your use of the applications, games, and websites published by Brain Guardian Labs, LLC ("BGL," "we," "our," or "us"). By downloading, installing, or using any of our software, you agree to these Terms.
We grant you a personal, non-exclusive, non-transferable, revocable license to use our applications for your own lawful purposes. You may not resell, redistribute, reverse engineer, or attempt to extract the source code of our software except where that restriction is prohibited by law.
Applications distributed through the Apple App Store are additionally governed by Apple's Standard End User License Agreement. Where that agreement and these Terms conflict for an App Store download, Apple's agreement controls.
Our handling of your information is described in our Privacy Policy, which forms part of these Terms. Several of our applications, including Swamp Chomp, collect no data at all. Where an application offers an optional feature that shares information with a third-party platform — such as a Game Center leaderboard — that feature is off until you turn it on, and the Privacy Policy explains what is shared.
You agree not to use our software to break the law, to interfere with or disrupt our services, to attempt to gain unauthorized access to our systems, or to harass or harm others.
Where an application offers a purchase or subscription, the transaction is processed by Apple and governed by your App Store account terms. Refunds are handled by Apple, not by us. Subscriptions renew automatically unless cancelled through your App Store account settings at least 24 hours before the end of the current period.
We may update, change, suspend, or discontinue any application or feature at any time. We will make reasonable efforts to avoid disrupting normal use, but we do not guarantee uninterrupted availability.
Our software is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Our applications are tools, not professional advice. Nothing produced by our software constitutes medical, veterinary, legal, financial, engineering, or other professional advice, and it should not be relied upon as a substitute for a qualified professional.
To the maximum extent permitted by law, Brain Guardian Labs, LLC is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of your use of our software.
All software, artwork, audio, names, and logos published by BGL remain our property or that of our licensors. These Terms do not transfer any ownership to you.
We may revise these Terms from time to time. When we do, we will update the date at the top of this page. Continuing to use our software after a change means you accept the revised Terms.
These Terms are governed by the laws of the State of Illinois, United States, without regard to its conflict of law provisions.
